§ 8.12.070. Containers.

  • A.

    Every resident or business in the city shall maintain for such residence or business a container, supplied by the contractor, for the collection and disposal of garbage. The resident or business shall arrange for a sufficient number of such garbage containers to adequately store all garbage generated in connection with the residence or business between the times designated for garbage collection.

    B.

    Every resident or business in the city shall maintain for such residence or business a container supplied by the city for the collection and disposal of recyclable materials. Each resident or business shall arrange for a sufficient number of recyclable materials containers to adequately store all recyclable materials generated in connection with the residence between the times designated for the collection of recyclable materials.

    C.

    Every resident in the city shall maintain for such residence a container, supplied by the contractor, for the collection and disposal of green waste, should the resident elect to participate in the green waste program.

    D.

    Garbage, recyclable materials and green waste containers shall be placed on the curb by the resident on the day specified for collection, unless an exemption has been granted by the city manager pursuant to this chapter.

    E.

    Collection for Disabled Persons. The city manager shall grant an exemption in the form of an alternate setout location to households whose occupants are physically unable to roll their containers to the curb. Households requesting an exemption shall submit an application to the city manager. A doctor's note and a signed statement, under penalty of perjury, must accompany the application stating that neither the occupant, nor any member of the occupant's household, is physically able to move the container to the curb. It shall be the responsibility of the holder of the exemption to arrange a suitable location for the container with the contractors. No additional fee will be charged for disabled persons' service. The city manager may grant temporary exemptions for persons with temporary disabilities.

    F.

    Garbage, recyclable materials and green waste containers shall be maintained in a sanitary condition at all times. Any bulky material must be reduced in size so that it may be placed in the appropriate container with the cover tightly closed and without excessive tamping, so that the container may be easily emptied.

    G.

    No person shall place garbage, recyclable materials and green waste containers for collection at any time other than the day or days established for collection, or earlier than sunset of the day preceding the day designated for collection. All garbage, recyclable materials and green waste containers shall be removed from the curb prior to midnight of the day the containers have been emptied.

    H.

    Every owner of a multiple-family dwelling shall provide individual garbage and recyclable materials containers for each dwelling unit. For multiple-family dwellings in excess of five units, the owner may provide, in place of individual garbage and recyclable materials containers, communal garbage and recyclable materials dumpsters for tenant use.

    I.

    If a business requires the use of more than four garbage containers, or the equivalent thereof, for the storage of garbage, the business shall provide a suitable screened area for these garbage containers. The design and location of this screened area must be approved by the city building inspector.
